 1st May, 2014

On 1st May 2014, new laws governing the use of mobile phones in the vehicle were introduced in Ireland

How does the new law affect hands-free kits?

...can they still be used?

I'm sure you have heard, but from the 1st of May 2014, motorists convicted of sending a text message or email while driving will face tough new penalties and a compulsory court appearance.

The new penalties come on top of existing penalties for holding a mobile phone while driving and apply specifically to sending SMS or MMS messages and emails. They also close a loophole which may have permitted motorists to send a text message if a phone was held in a cradle within the car.

The new rules, mean anyone caught texting or “accessing information” on their phones will face a mandatory court appearance and a fine of up to €1,000 for a first offence. This will rise to a maximum of €2,000 for a second offence, and a possible three-month jail sentence, along with a €2,000 fine, for three offences or more within a 12-month period.

Many news outlets have reported this news in a way that suggested that using a hands-free kit was also illegal, however the law states that drivers will be punished for holding a mobile phone, texting from or accessing information on their phone - even if it was cradled or connected to a hand-free kit.

Using a voice activated hands-free kit is still legal - as long as the phone is not being using to launch the call.
